Our shared framework

1. General provisions

§ 1

Name, legal form, registered office

(1) The club was founded in 1930 and bears the name “Sportfreunde 1930 Uevekoven e.V.”.

(2) The club is a registered association (eingetragener Verein, entered under number 386 in the register of associations at Erkelenz local court) and has its registered office in Uevekoven.

§ 2

Purpose, charitable status

(1) The purpose of the club is to foster sport (in particular football) and to promote the sporting activity of its members. The club's purpose is achieved, among other things, through:

  1. participation in competitions and other sporting events,
  2. the creation of training opportunities,
  3. the acquisition and maintenance of sports facilities and sports equipment,
  4. contributions and other services to charitable organisations in sport and youth welfare.

(2) The club exclusively, directly and selflessly pursues charitable purposes within the meaning of the section “tax-privileged purposes” of the German Fiscal Code (Abgabenordnung). The club's funds may only be used for the purposes laid down in the statutes. Members receive neither shares in profits nor allocations from the club's funds. No person may be favoured by expenditure alien to the purpose of the club or by disproportionately high remuneration.

§ 3

Structure, legal framework, financial year

(1) The club is divided into:

  1. football section,
  2. youth football section.

(2) The sections run and administer themselves independently; this also applies to the use of the funds they receive. The general meetings (Mitgliederversammlungen) have the right to regulate their affairs and youth work within the framework of these statutes by means of rules of procedure and youth regulations.

(3) The youth sections consist of the young people of the section and the elected or appointed officials working in the youth area. A young person is anyone who, under the provisions of the youth match regulations (Jugendspielordnung) of the Westdeutscher Fußballverband (West German Football Association), is eligible to play for a youth team or could be eligible on account of their age.

(4) The club is a member of the Fußballverband Mittelrhein (Middle Rhine Football Association). The club and the members of the relevant sections submit to the statutes and regulations of the Fußballverband Mittelrhein, the Westdeutscher Fußballverband and the Deutscher Fußball Bund (German Football Association), insofar as generally binding provisions of these associations do not conflict, the club regulates its affairs independently.

(5) The financial year is the calendar year.

2. Membership

§ 4

Ordinary members

(1) All persons with legal capacity may become ordinary members of the club, regardless of their gender, nationality, religion, race, party affiliation or profession. There is no entitlement to admission to the club.

(2) The club consists of active and inactive members. Active members contribute to fulfilling the club's purpose primarily by taking part in sporting activities or by helping with the administration of the club and of the club section they have joined. For inactive members, the emphasis is on supporting the tasks laid down in the statutes for the club or for particular club sections through contributions in cash or in kind.

(3) By joining the club, members submit to the statutes and regulations of the club and of the associations to which the club belongs.

§ 5

Acquisition of membership

(1) The acquisition of membership requires the applicant's membership form stating the club section (in the case of minors, additionally the prior or subsequent consent of their legal representative) and the club's declaration of admission.

(2) The membership form must be submitted in writing to a member of the club board (Gesamtvorstand) or of the section board (Abteilungsvorstand), or to the head of youth, their deputy or the youth secretary (Jugendgeschäftsführer). The board members and the aforementioned members of the youth committee (Jugendausschuss) are authorised to complete admission to the club by accepting the membership form. Admission takes effect upon unconditional receipt of the membership form or upon notification of the admission decision.

(3) A membership form may only be rejected by the section board or the youth committee; no reasons need be given for the decision.

§ 6

Loss of membership

(1) Membership ends by resignation or expulsion.

(2) Resignation must be declared in writing to a member of the club board or of the section board, or to the head of youth, their deputy or the youth secretary. It is only possible with effect from 31 July (end of the season) or 31 December (end of the financial year); the notice of resignation must be sent no later than one month beforehand (by 30 June or 30 November). The section board and the youth committee reserve the right to agree to an early termination of membership in exceptional cases.

(3) Expulsion of a member is only permitted for good cause. Good cause exists, among other things, if a member is guilty of conduct damaging to the club, deliberately disregards provisions of the statutes, resolutions of the general meeting or of a governing body of the club or section, has not paid membership fees despite a reminder, the setting of a deadline and a warning of expulsion. Expulsion may only be decided by the section board or the youth committee. Before the decision, the member must be given the opportunity to state their position. Reasons must be given for the decision, and it must be sent to the member by registered post. Expulsion takes effect at the end of the third day after the registered letter has been posted.

§ 7

Rights of members

Members have the right to use the facilities of the club section to which they belong, to take part in the events of the section and of the club as a whole, and to participate in the decision-making and self-administration of the section and the club.

§ 8

Duties of members

(1) Members are obliged to observe the provisions of the statutes and regulations that are binding on them and to follow the instructions of the general meeting of the club board, the section board and the committee members.

(2) Members must pay the joining fees and membership fees set by the section general meeting. In exceptional cases, the section board or the youth committee may defer payment of joining fees and membership fees or waive them in whole or in part.

(3) In the event of breaches of duty, the section board or the youth committee may, after first hearing the accused, impose on them a playing ban of up to one year and a fine of up to DM 250. These penalties may also be imposed together. Reasons must be given for the decision, and it must be served on the member by registered post.
